2. Subject Matter and Scope of the Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the rights and obligations between VON Property Services s. r. o. as the provider of accommodation services (hereinafter referred to as the “Operator”) and the customer (hereinafter referred to as the “Guest”) who books accommodation via the website teryhochata.sk or by another method accepted by the Operator.

3. Reservations and Payment Terms

3.1. Reservations are made via the online reservation system on the website majekovachata.sk or by email at ahoj@majekovachata.sk.

3.2. After making a reservation, the Guest is required to pay a deposit for the accommodation:

by online card payment – immediately upon confirmation of the reservation,

by bank transfer – within 5 business days of making the reservation.

3.3. When paying by bank transfer, this option is recommended only for reservations where the check-in date is at least 3 weeks from the reservation date, so that the payment can be identified in time.

3.4. The reservation becomes binding only after the deposit has been credited to the Operator’s account.

3.5. The balance for accommodation and local taxes are to be paid on site upon arrival in cash or by card, if technical conditions permit.

4. Local Accommodation Tax

The accommodation price does not include the local accommodation tax of 1 EUR per person per night, which is to be paid on site upon arrival.

5. Cancellation Policy

5.1. The guest has the right to cancel the reservation by sending an email to ahoj@majekovachata.sk.

5.2. Cancellation fees:

22 or more days before arrival: the deposit is refunded in full,

14–21 days prior to arrival: the deposit is non-refundable, but the reservation may be rescheduled to another date,

less than 14 days prior to arrival: both the deposit and the reservation are forfeited to the Operator.

5.3. If the Guest fails to arrive without canceling the reservation (“no-show”), the deposit is forfeited in full to the Operator and the reservation is automatically canceled without entitlement to compensation.

5.4. The Operator reserves the right to cancel the reservation in cases of force majeure (e.g., adverse weather, trail closures, technical malfunctions, extraordinary circumstances). In such cases, the deposit paid will be refunded in full.

 

6. Corporate Reservations

For group reservations and corporate events, accommodation and payment terms can be arranged individually via email at ahoj@majekovachata.sk.

7. Complaints and Liability

7.1. The Guest is required to immediately report any deficiencies in services directly to the Operator.

7.2. The Operator is not liable for the loss, damage, or theft of items that the Guest leaves outside the areas designated for their storage.

7.3. The Operator is not liable for failure to fulfill obligations caused by force majeure or events beyond its control (e.g., power outages, changes in weather conditions, sidewalk closures, intervention by mountain rescue services).

8. Termination of the Contract

The Guest is entitled to terminate the accommodation contract in accordance with these GTC. The Operator is entitled to terminate the contract if the Guest violates the house rules, causes damage to property, endangers safety, or fails to follow staff instructions.

9. Protection of Personal Data (GDPR)


9.1. The Operator processes Guests’ personal data to the extent necessary to process reservations, provide accommodation, and comply with legal obligations.
9.2. The legal basis for processing is the conclusion and performance of the accommodation contract, legal obligations, and the Operator’s legitimate interest.
9.3. Personal data is not disclosed to third parties, with the exception of the accounting firm, tax authorities, and the payment gateway operator (Global Payments), which processes payment transactions.
9.4. The retention period for personal data is 5 years from the end of the accommodation, in accordance with the Accounting Act.
9.5. The Guest has the right to request access to, correction of, or deletion of their personal data, as well as to file a complaint with the Slovak Data Protection Authority.

10. Final Provisions


10.1. These Terms and Conditions are an integral part of every reservation. By submitting a reservation, the Guest confirms that they have read and agree to these Terms and Conditions.
10.2. Legal relationships not governed by these terms and conditions are governed by the relevant provisions of the Civil Code of the Slovak Republic.
10.3. Any disputes between the Operator and the Guest shall be resolved primarily by mutual agreement. If no agreement is reached, the Slovak Trade Inspection (SOI) is the competent authority for the out-of-court resolution of consumer disputes.
